If the deceased failed to make a valid will then the law on Intestacy would apply.

The size of the estate and the amount of inheritance tax to be paid would have to calculated.

The next of kin or near relative/s to the deceased would then have to apply to the Court to confrim their realationship to the deceased and that they would adminster the deceased's estate in accordance with the rules on intestacy.

The Court would then grant letters of Administration.
